September 23, 2020 Opinion or Order Filing 18 ORDER This matter is before the Court on #16 Motion to Amend Complaint. Pursuant to Federal Rule of Civil Procedure 15(a)(1)(B), a party may amend its pleading once as a matter of course within 21 days after service of a motion under Rule 12(b), if the pleading is one to which a responsive pleading is required. Having met those conditions, the Clerk of Court is instructed to enter [16-1] as Plaintiffs First Amended Complaint. Pursuant to D.C.COLO.LCivR 15.1, a party is required to supply the Court with a redlined copy of the proposed amended pleading, which strikes through the text to be deleted and underlines the text to be added. Plaintiff has not provided a redlined copy of the complaint, and is thus ORDERED to file a notice of filing of the Amended Complaint that attaches as an exhibit a redline of the amended complaint on or before October 7, 2020. Because Plaintiff has now filed an Amended Complaint, the Motion to Dismiss Plaintiff's original complaint is moot. See Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991) ("It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect."); Glass v. The Kellogg Co., 252 F.R.D. 367, 368 (W.D. Mich. 2008) ("Because the original complaint has been superseded and nullified, there is no longer a live dispute about the propriety or merit of the claims asserted therein; therefore, any motion to dismiss such claims is moot.").
