ORDER This matter is before the Court on #24 Stipulated Motion to Dismiss Defendant UCHealth University of Colorado Hospital ("UCHealth") With Prejudice (the "Stipulation"), in which Plaintiff and UCHealth stipulate to the dismissal of Plaintiff's lawsuit against UCHealth. Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), a plaintiff may dismiss an action without an order of the Court by filing a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment. Thus, because UCHealth has not yet either answered or filed a motion for summary judgment, Plaintiff's claims against UCHealth were dismissed as of the filing of the Stipulation and no order of the Court is necessary. The Clerk of Court is directed to terminate UCHealth as a defendant in this action and to mail a copy of this Order to Plaintiff. SO ORDERED, by Magistrate Judge Scott T. Varholak on 11/18/2020.
