The CSU-Pueblo Defendants carefully analyzed the case status pursuant to String Cheese Incident, LLC v. Stylus Shows, Inc., No. 1:02-CV-01934-LTB-PA, 2006 WL 894955 (D. Colo. Mar. 30, 2006), and, having reviewed the pending #47 Motion to Dismiss, in which the defendants raise the Eleventh Amendment and qualified immunity as defenses, the court agrees with Defendants' analysis regarding a stay. The Court has reviewed the parties' letters, ECF Nos. 38 and 40. It appears to the Court that before any motion to dismiss is filed, the plaintiffs should amend their complaint, taking into account the issues discussed in the letters. That was one purpose of the conferral process. The Court also believes that the plaintiffs need to take another look at the qualified immunity issue as it relates to claims against the individual defendants for damages. Established law is not determined by a district court in Michigan. Rather, it is established by the Supreme Court, the Tenth Circuit, or a consensus among other circuits. Once plaintiffs have reconsidered and amended their complaint, which should be completed by May 31, 2021, then defendant may proceed with a motion if they still believe it is appropriate. However, the Court will construe all facts alleged in the amended complaint (which hopefully will be succinctly stated and will avoid conclusory statements) in plaintiffs' favor. The granting of a motion to dismiss without a specific legal deficiency in the pleading is rare, and defendant might want at that point to save it for a motion for summary judgment. By Judge R.
