Filing 17 ORDER: This matter is before the Court on Plaintiff's motion for extension of time #15 #16 to respond to the Order to Show Cause #6 . Although Plaintiff is proceeding pro se, the Court does not afford his filings the liberal construction ordinarily given to pro se filings because he is an attorney. See Smith v. Plati, 258 F.3d 1167, 1174 (10th Cir. 2001). In this case, the Court has already dismissed the action without prejudice for lack of subject matter jurisdiction and the Clerk has entered final judgment. Accordingly, Plaintiff cannot simply move for an extension of time. Instead, if Plaintiff seeks relief from the judgment, he must do so under an applicable rule(s) and the appropriate legal authority. It is therefore ORDERED that Plaintiff's motion for extension of time #15 is DENIED WITHOUT PREJUDICE. SO ORDERED by Judge Raymond P. Moore on 12/2/2020. (Text Only Entry)(rmsec ) |
