ORDER. Instead of filing a Scheduling Order which by definition proposes a schedule for conducting discovery the parties have filed an incomplete order which essentially gives them an unauthorized stay of discovery until after the court has ruled on a pending motion to dismiss. This is inappropriate. If the parties desire a stay they must file an appropriate motion addressing each of the criteria outlined in String Cheese Incident, LLC. v. Stylus Shows, Inc., 02CV01934LTBPAC, 2006 WL 894955, at *2 (D. Colo. Mar. 30, 2006) and receive permission to stay discovery from the court. Therefore, the proposed scheduling Order [Doc. No. 18] is hereby STRICKEN. ORDER REFERRING CASE to Magistrate Judge Kathleen M. Tafoya. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ.
