Filing 19 ORDER ON PENDING MOTIONS by Magistrate Judge Nina Y. Wang on 1/13/2021. This matter comes before the court on three motions filed by Plaintiff. First, the court CONSTRUES #9 Motion for Extension of Time to File as a Response to Defendant's #8 Motion for an Extension of Time and is therefore not a proper motion. Further, consistent with Magistrate Judge Gallagher's order stating that "[i]f and when the case is drawn to a presiding judge, Defendant will be properly served and ordered to file a responsive pleading," Defendant is ORDERED to file a responsive pleading on or before January 29, 2021. Second, the court STRIKES #10 Motion for Default Judgment, because Plaintiff may not seek default judgment until and unless the Clerk of the Court first enters default against Defendant, which has not happened. Fed. R. Civ. P. 55. Third, and finally, the court DENIES #16 Motion for Leave to Restrict, because the use of the initials of Plaintiff's minor children is consistent with Rule 5.2 of the Federal Rules of Civil Procedure, and the court finds no justification for restricting Plaintiff's Motions to proceed in forma pauperis. See Slivka v. Young Mens Christian Ass'n of Pikes Peak Region, 390 F. Supp. 3d 1283, 1288 (D. Colo. 2019) (explaining that a motion to restrict will be granted only if the movant can "articulate a real and substantial interest that justifies depriving the public of access to documents that inform the courts decision-making process.").
