October 6, 2021 Opinion or Order Filing 11 MINUTE ORDER: The Court held a status conference by VTC in this case today's date. The hearing was originally set as a preliminary injunction hearing, to begin at 9:00 a.m. Government counsel (Butler and Uhalde) appeared. It took about 45 minutes for Mrs. Harrington to connect, as she was having technical difficulties, but she did finally connect by telephone only, no video. In response to questions from the Court, Mrs. Harrington indicated that she is familiar with the case and the related case in Chief Judge Brimmer's court involving her husband. 19-cv-02965-PAB. She is considering hiring counsel but indicted she has had poor experiences with counsel in the past. Later in the discussion she expressed that she did not know how to find a good lawyer, and she asked the Court for recommendations. The Court provided three names, two in Denver and one in Grand Junction where she lives, for her to consider in addition to whomever else she might wish to consider. Mrs. Harrington, again in response to a question from the Court, indicated that she did not feel comfortable agreeing voluntarily to transfer $2.2 million from her Swiss account at Vontobel Bank (where she has apparently held the funds since 2015, according to the governments information) to the court registry until she consults a lawyer. The Court agreed that this made sense. In response to another question from the Court, Mrs. Harrington agreed that on a temporary basis, i.e., until she retains counsel and we decide what the next steps are, (1) she would not transfer the funds in the Vontobel account to another account; (2) she would not deplete the account below $2.2 million; and (3) she would remain within the jurisdiction of the United States. That agreement addressed the irreparable harm issue raised in the government's pending motion for a preliminary injunction, and government counsel indicated that they did not object to resolving today's issues that way. The Court will decide after she retains counsel (if she does; she estimated that it would take her a couple of weeks to do this, and she will inform the Court and government counsel when she has counsel) what needs to be done next. The Court has consulted with Chief Judge Brimmer, and in light of his very heavy schedule in October which includes an eight-week jury trial beginning October 25, 2021, that this Court will deal with the preliminary injunction issue as needed. The Court will likely set a one or two day evidentiary hearing on the motion for preliminary injunction sometime in mid to late October or in November unless the issue can be resolved by agreement of the parties.
