ORDER Defendants have requested leave to file a motion to compel under Fed. R. Civ. P. 37 and presumably seek sanctions. Plaintiff opposes. The discovery in this case has involved excessive judicial resources. Because I do not see this pattern ending, this is the unusual case in which I believe resorting to the old fashioned way of dealing with the types of issues identified by Defendants (as opposed to the informal discovery conferences that the Court has attempted so far) is necessary. The parties shall engage in one final conferral, after which Defendants shall send a letter to Plaintiff clearly identifying any incomplete responses that persist. Three business days after that letter, if Defendants believe Plaintiff has still fallen short of its discovery obligations, Defendants may file a Rule 37 motion.
