This matter is before the Court on the parties' Stipulated Motion for Dismissal With Prejudice #10 ("Motion"). Fed. R. Civ. P. 41(a)(1)(A)(ii) provides that a plaintiff mayvoluntarily dismiss an action "without a court order by filing:... a stipulation of dismissal signed by all parties who have appeared." Here, because counsel for all parties of record have signed and joined in the request, the Court construes the Motion #10 as a stipulation under Fed. R. Civ. P. 41(a)(1)(A)(ii). Accordingly, because no Court order is necessary to effectuate the parties' request, IT IS HEREBY ORDERED that the Clerk of Court shall CLOSE this case pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii). IT IS FURTHER ORDERED that the pending Motions [#9, #10] are DENIED as moot.(csarr, )
