Filing 15 ORDER granting #11 Motion for Extension of Time to Answer or Otherwise Respond. SO ORDERED by Magistrate Judge S. Kato Crews on 4-20-2022. Text Only Entry (skclc2). |
Filing 14 ORDER denying #12 Motion for Entry of Default. The parties previously agreed to an extension of time for Defendants to answer or otherwise respond. And yet, Plaintiff filed this Motion for entry of default the day after the agreed upon date for Defendants to answer. Defendants, seemingly prodded by Plaintiff's Motion, filed their motion to dismiss a day late. This is the epitome of a waste of judicial resources. The better course of action would have been for the parties to confer once it was apparent that Defendants were not going to make their new deadline (as they previously did). Going forward, the Court expects the parties to adhere to deadlines and confer in good faith before filing any motions. Given that Defendants have responded to the Complaint, the Motion is DENIED. by Magistrate Judge S. Kato Crews on 4-20-2022. Text Only Entry (skclc2). |
