Filing 29 NOTICE re #28 Consent to Jurisdiction of Magistrate Judge [Joint] by Defendants Jeff Hawkins, Andrew E. Hayes (Smith, Ann) |
Filing 28 PLAINTIFF'S CONSENT to Jurisdiction of Magistrate Judge by Plaintiff David Scott Hayden(trvo, ) |
Filing 27 MINUTE ORDER denying without prejudice #21 Motion to Place Defendants in the Following Order of Appearance; #22 Motion for Chad Wolgram to Provide State Inspection(s); #23 Motion to Issue a Cease and Desist Order; #24 Motion for Judge Martinez and Magistrate Judge Dominguez Braswell to Travel to Pueblo, Colorado to View My Properties; and #25 Motion for All Documents from Army Corps of Engineers. The Motions fail to comply with D.C.COLO.LCivR 7.1(a). Although Plaintiff states that he conferred with opposing counsel before filing each Motion, Plaintiff does not state whether, or to what extent, Defendants oppose the particular relief sought. The Tenth Circuit has cautioned that pro se litigants "must follow the same rules of procedure that govern other litigants." Green v. Dorrell, 969 F.2d 915, 917 (10th Cir. 1992). The Local Rules of Practice for the District of Colorado require all parties to confer on motions and other disputes before a motion is filed, and to "describe in the motion... the specific efforts to fulfill this duty." D.C.COLO.LCivR 7.1(a). The Court reminds Plaintiff of the duty to confer, and cautions that any future motions filed without conferring will likely result in the denial of those motions. Plaintiff's pro se status does not entitle him to an application of different rules. Montoya v. Chao, 296 F.3d 952, 957 (10th Cir. 2002). By Magistrate Judge Maritza Dominguez Braswell on 09/07/22.
