Filing 11 RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE re #1 Prisoner Complaint filed by Willis Earl Jenkins, Jr. For the reasons set forth herein, this Magistrate Judge respectfully RECOMMENDS that the 1983 claims asserted against Defendants ONeil and Ravencamp in the Prisoner Complaint be DISMISSED WITHOUT PREJUDICE pursuant to 28 U.S.C. 1915(e)(2)(B) as duplicative of the claims asserted against those individuals in Case No. 21-cv-03403-RM-MDB, which is pending. This Magistrate Judge further respectfully RECOMMENDS that the 1983 claims asserted against Defendants EL Paso County Jail and Bill Elder be DISMISSED WITHOUT PREJUDICE pursuant to Fed. R. Civ.
