MINUTE ORDER by Magistrate Judge Gordon P. Gallagher on 10/31/2022. To the extent the Motion to Modify/Extension (ECF No. #4 ) is requesting a copy of the court-approved forms and an extension of time to cure the filing deficiencies in this case, this request is granted as follows. The Clerk of Court is directed to mail to Plaintiff, with this minute order and the applicable instructions, a blank copy of the following forms: (1) Prisoner Complaint; (2) Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915; (3) Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241; and (4) Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action. Because it remains unclear what relief Plaintiff seeks in this action since she has filed both a Prisoner Complaint and 2241 Application, the Court is sending Plaintiff both the forms. Though both sets of forms are being sent, Plaintiff is advised that she can only submit one set of forms in this action, depending on what type of relief she seeks. If she wishes to pursue both types of claims, she must initiate a new action. She cannot pursue civil rights claims and habeas corpus claims in the same action. Plaintiff is reminded that, to proceed with this action, she must (1) file one complete pleading on a court-approved form, and (2) address the filing fee either by submitting the correct form motion or prepaying the filing fee in full. Plaintiff shall have up to and including November 30, 2022, to cure the deficiencies. Plaintiff is reminded that this action will be dismissed without further notice if she fails to cure the deficiencies within the time allowed. (athom, ) (forms mailed as ordered)

ORDER DIRECTING MS. CISNEROS TO CURE DEFICIENCIES, within thirty (30) days from the date of this Order. Ms. Cisneros must clarify whether she desires to asserts claims in a federal habeas corpus action or civil rights lawsuit under 42 U.S.C. 1983. Any papers that Ms. Cisneros files in response to this Order must be labeled with the civil action number identified on this Order. It is FURTHER ORDERED that Ms. Cisneros shall use the appropriate Court approved form for filing (1) an Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2254 or 2241 and Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action; or (2) a Prisoner Complaint and Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915. These forms may be obtained with the assistance of her case manager or the facility's legal assistant, along with the applicable instructions, at www.cod.uscourts.gov. It is FURTHER ORDERED that if Ms. Cisneros fails to cure the designated deficiencies within thirty (30) days from the date of this Order, the action will be dismissed without further notice.
