Filing 11 ORDER REFERRING CASE: This case is referred to Magistrate Judge Kristen L. Mix for non-dispositive matters. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, (3) hear and determine pretrial matters, including discovery and other non-dispositive motions, and (4) conduct a pretrial conference and enter a pretrial order. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the recommendation or informal request of the Magistrate Judge or on the request of the parties by motion, this court may direct the parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. Counsel for the Parties and all counsel who may later enter an appearance shall review and familiarize themselves with the undersigned's Practice Standards, as well as the Practice Standards of the assigned Magistrate Judge. Filing 10 MINUTE ORDER: Upon review of the #8 Plaintiff's Response to Second Show Cause Order and the #9 Second Amended Complaint, the Court is satisfied that Plaintiff has sufficiently alleged complete diversity of the Parties in this case, and thus, he has sufficiently established this Court's subject matter jurisdiction. Accordingly, the #4 Order to Show Cause is hereby DISCHARGED. With respect to the Second Amended Complaint, the Court notes that Rule 15 of the Federal Rules of Civil Procedure provides that a party "may amend its pleading once as a matter of course." Fed. R. Civ. P. 15(a)(1) (emphasis added). Plaintiff used his one amendment as a matter of course when he filed his #6 First Amended Complaint on November 17, 2022. However, because the Federal Rules of Civil Procedure are to be "construed, administered, and employed by the court and the parties to secure the just, speedy, and inexpensive determination of every action and proceeding," see Fed. R. Civ. P. 1, the Court will sua sponte grant Plaintiff leave to amend his First Amended Complaint, and the Second Amended Complaint is accepted as filed. Plaintiff is advised that should he seek any further amendments of his pleading, a formal motion that complies with the Federal Rules and the Local Rules of Practice will be required.
