January 9, 2023 Opinion or Order Filing 11 DISCHARGED ORDER TO SHOW CAUSE returnable January 13, 2023. The party invoking jurisdiction of a federal court bears the burden of establishing that jurisdiction is proper. Merida Delgado v. Gonzales, 428 F.3d 916, 919 (10th Cir. 2005). Defendant's Notice of Removal alleges that the Court has jurisdiction pursuant to 28 U.S.C. 1332 based on the diversity of the parties. Per 28 U.S.C. 1332(c)(1), "a corporation shall be deemed to be a citizen of every State and foreign state by which it has been incorporated and of the State or foreign state where it has its principal place of business." The Notice of Removal states the Plaintiff is a citizen of the State of Colorado (ECF No. 1 at 9), but says nothing about its principal place of business. Accordingly, the Defendant is ORDERED TO SHOW CAUSE no later than January 13, 2023 as to why the Court should not dismiss this action sua sponte based on Defendant's failure to allege sufficient facts to show that the Court has diversity jurisdiction over this matter.
