ORDER granting #14 Joint Motion to Reset. The Scheduling Conference set for 8/23/2023 is VACATED and RESET for 9/26/2023 09:00 AM in Courtroom A 402 before Magistrate Judge Scott T. Varholak. Proposed Scheduling Order due 9/19/2023. The Court further notes that Plaintiff has still not filed a Rule 7.1(a)(2) citizenship disclosure statement. Pursuant to Fed. R. Civ. P. 7.1(a)(2), all parties in a diversity case must file a disclosure statement that names and identifies the citizenship of every individual or entity whose citizenship is attributed to that party. The Committee Notes state that "[d]isclosure is required by a plaintiff" and the disclosure "is designed to facilitate an early and accurate determination of jurisdiction." Fed. R. Civ. P. 7.1 (Advisory Comm. Notes). Such statement must be filed with the party's first appearance. Fed. R. Civ. P. 7.1(b)(1). Pursuant to #7 Order, each party was to ensure that the citizenship disclosure statement required by Fed. R. Civ. P. 7.1(a)(2) had been filed on or before 8/9/2023. When no compliant disclosures were filed, the Court extended the deadline to 8/16/2023. [See #11] Defendant has filed a compliant disclosure statement. [See #12]. Plaintiff has not. While Plaintiff has filed a "Corporate Disclosure Statement," it does not identify Plaintiff's citizenship. [See #4] The Court ORDERS that Plaintiff shall file a disclosure statement that identifies Plaintiff's citizenship--as required by the Federal Rules of Civil Procedure--on or before 8/24/2023.
