Filing 8 Minute Order by Magistrate Judge Susan B. Prose on 08/22/2023. In response to the Court's Order Directing Petitioner to Cure Deficiencies (ECFNo. #3 ), Petitioner has submitted a Prisoner's Motion and Affidavit for Leave to Proceedon Appeal Pursuant to 28 U.S.C. 1915 and Fed. R. App. P. 24 in a Habeas CorpusAction (ECF No. #6 ) and a Motion for Bond/Bail Pending Review of the Plaintiff's Application for Habeas Corpus Relief (ECF No. #7 ). But Petitioner's filings only cure one of two filing deficiencies. Petitioner was also ordered to file a fully completed copy of the court-approved form Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2254. Petitioner shall have until September 21, 2023 to cure the remaining deficiency by submitting a habeas corpus application on the court-approved form. Petitioner's Motion for Bond/Bail Pending Review of the Plaintiff's Application for Habeas Corpus Relief (ECF No. #7 ) is denied without prejudice as premature. Petitioner must first file a habeas corpus application on the required form. Petitioner is reminded that this action may be dismissed without further notice if he fails to cure the remaining filing deficiency within the time allowed. (pklin, ) |
