ORDER TRANSFERRING CASE: Plaintiff, proceeding pro se, brings this action challenging the conditions of his confinement at the United States Penitentiary ADMAX in Florence, Colorado (USP Florence.) ECF No. 1. For the reasons set forth in the attached Order, the action is transferred to the United States District Court for the District of Colorado. The Clerk of Court is directed to transfer this action to the United States District Court for the District of Colorado. See 28 U.S.C. 85, 1406(a). The Court offers no opinion on the merits of this action. Plaintiff did not pay the filing fee or request to proceed in forma pauperis. The provision of Local Rule 83.1 requiring a seven-day stay is hereby waived. No summons will issue from this Court, and the Clerk of Court is respectfully directed to mark this case closed upon transfer.The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
