ORDER GRANTING 29 Unopposed Motion to Consolidate. Plaintiffs Mario Ortega and Kamille Faye Vinluan-Jularbal move to consolidate their later-filed case, Ortega v. Similasan Corp., No. 1:23-cv-02990-MEH (D. Colo. filed Nov. 10, 2023), with 23-cv-2511-DDD-STV. A court may consolidate two actions if they involve a common question of law or fact. Fed. R. Civ. P. 42(a); see also Local Civ. R. 42.1. The two cases at issue involve common questions of law and fact, as both are putative class actions against Defendant Similasan Corporation alleging, among other things, violations of state consumer-protection statutes on behalf of a class of consumers who purchased the defendant's allegedly defective eye drops. All parties in both cases consent to consolidation. Accordingly, the plaintiffs' motion is granted, and 23-cv-2511-DDD-STV is hereby CONSOLIDATED with case No. 1:23-cv-02990-MEH.
