On November 30, 2023, the Court ordered plaintiff New Direction Partners of CO, LLC to file a Rule 7.1 disclosure statement identifying its citizenship. Docket No. 16 . On December 4, 2023, plaintiff filed a Rule 7.1 disclosure statement identifying Patrice M. Reilly and Paul V. Reilly as the members of the LLC and stating that both of these individuals are Colorado residents. Docket No. #18 at 1. However, residency is not equivalent to citizenship for purposes of federal diversity jurisdiction; rather, "[f]or purposes of federal diversity jurisdiction, an individual's state citizenship is equivalent to domicile." Smith v. Cummings, 445 F.3d 1254, 1259 (10th Cir. 2006). "To establish domicile in a particular state, a person must be physically present in the state and intend to remain there." Id. at 1260.
