Filing 15 ORDER This matter is before the Court on Defendants' #11 Motion for Extension of Time to Answer or Otherwise Respond (the "Motion"). The Motion requests an additional 21-day extension of time to respond to Plaintiff's Complaint, citing "considerable difficulty in locating and identifying the statements Plaintiff utilizes in [the Complaint]." [#11 at 3] Plaintiff opposes the Motion, noting that Defendants were served on December 19, 2023, and the parties have already stipulated to a 21-day extension of time for Defendants to answer the Complaint. Plaintiff argues that this stipulated extension provided Defendants with sufficient time to investigate the statements alleged in the Complaint for the purposes of responding. Upon review of the Complaint, the Court agrees with Defendants that the allegations span a number of years and include references to specific statements that may reasonably, and through no fault of the Defendants, require additional time to investigate for the purposes of responding to the Complaint. On the other hand, the Court also agrees with Plaintiff that an additional three-week extension of time is excessive, particularly in light of the parties' previous stipulation. Accordingly, the Court finds good cause to GRANT the Motion IN PART, and extends Defendants' deadline to answer or otherwise respond to the Complaint by ten (10) days. Defendants' answer(s) or other response(s) due on or before 2/12/2024. SO ORDERED, by Magistrate Judge Scott T. Varholak on 1/23/2024. Text Only Entry(stvlc4, ) |
