Filing 5 ORDER: In conducting its initial review of this case, the Court notes the Complaint is facially insufficient to survive a Fed. R. Civ. P. 12(b)(6) challenge. Although the Complaint purports to be based on retaliation, termination of employment, and different terms and conditions of employment, there is not a single factual allegation to support these contentions. Plaintiff has not described what his employment was, how he was treated differently from others, what protected conduct he engaged in, or how he was retaliated against. Instead, Plaintiff's "supporting facts" consist only of a list of documents (an email of the formal complaint, the EEOC right to sue letter, and a witness list). However, Plaintiff has only included the EEOC right to sue letter and even this is devoid of allegations. Fed.R.Civ.P. 8(a) states, "A pleading that states a claim for relief must contain: (1) a short and plain statement of the grounds for the court's jurisdiction, unless the court already has jurisdiction and the claim needs no new jurisdictional support; (2) a short and plain statement of the claim showing that the pleader is entitled to relief; and (3) a demand for the relief sought, which may include relief in the alternative or different types of relief." Plaintiff's Complaint in its present form does not come even close to satisfying this minimal standard. To be sure, it does not include any claims at all. Consequently, IT IS ORDERED on or before February 29, 2024, Plaintiff shall file an Amended Complaint that complies with Rule 8 and contains factual allegations demonstrating Plaintiff is entitled to relief. If Plaintiff fails to comply with this Order, he risks having his Complaint dismissed for failure to state a claim. SO ORDERED by U.S. District Judge S. Kato Crews on 1/30/2024.
