Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, and (3) hear and determine pretrial matters, including discovery and other non-dispositive motions. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the request of the parties by motion, this Court may direct the parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. February 1, 2024 Opinion or Order Filing 14 MINUTE ORDER This matter is before the Court on review of #13 Election Concerning Consent/Non-Consent to United States Magistrate Judge Jurisdiction (the "Consent Form"), filed by Plaintiff. The Consent Form contains signatures of Plaintiff's counsel, the president of Defendant Hawaiian Springs LLC, and the president of Defendant HSW Holdings Corporation. No counsel has entered on behalf of either Defendant. Pursuant to D.C.COLO.LCivR 40.1(c)(6), an order of reference may be entered when "all parties consent to magistrate judge jurisdiction." Here, the two Defendants are both entities. "A corporation or other business entity can only appear in court through an attorney and not through a non-attorney corporate officer appearing pro se." Harrison v. Wahatoyas, L.L.C., 253 F.3d 552, 556 (10th Cir. 2001). Accordingly, the Court is unable to accept the signatures of Defendants' president, and no order of reference may enter.
