In response to the Court's Order Directing Plaintiff to File Amended Complaint (ECF No. #5 ) Plaintiff has submitted an amended Prisoner Complaint (ECF No. #7 ), an Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 (ECF No. #8 ), and a Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action (ECF No. #9 ). All three documents bear the case number for this action, 23-cv-00314-SBP, but the Respondent listed in the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 (ECF No. #8 ) is Plaintiff's current custodian, Denver Sheriff Elias Diggins. It appears that Plaintiff seeks to pursue claims for habeas corpus relief in addition to his claims in this action. Therefore, the Court will open a separate habeas corpus action. The Clerk of Court is directed to remove the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 (ECF No. #8 ) and the Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action (ECF No. #9 ) from this action and file those documents in a separate civil action.
