Filing 7 ORDER by Magistrate Judge Susan Prose on 2/15/2024, granting in part and denying in part #4 Plaintiff's Motion to Expedite limited discovery. Although unusual, the court has discretion to authorize an early subpoena for deposition testimony pursuant to Fed. R. Civ. P. 26(d)(1) and does so here based on the unique circumstances that Plaintiff describes in his motion and the court's assessment that this approach will facilitate the "just, speedy, and inexpensive determination" of this action by identifying and narrowing the potential defendants in this case. See Fed. R. Civ. P. 1. Plaintiff is authorized to promptly issue and serve pursuant to Fed. R. Civ. P. 4 a subpoena for a Fed. R. Civ. P. 30(b)(6) deposition of the Colorado Department of Corrections on only the topics stated on page 5 of the motion. The deposition shall be limited to two hours in length. The court denies Plaintiff's requests for documents, which seek information that appears duplicative of that to be elicited from a Rule 30(b)(6) deponent.Before attempting service, Plaintiff shall first contact the Colorado Attorney General's office to request waiver of service of the subpoena.
