April 29, 2024 Opinion or Order Filing 17 MINUTE ORDER On April 10, 2024, the copy of the March 27, 2024 minute order (ECF No. #9 ) sent to Plaintiff at the Weld County Jail was returned to the Court as undeliverable. (See ECF No. #10 ). Plaintiff filed a notice of address change on April 15, 2024 (ECF No. 12). A copy of the March 27 minute order was then sent to Plaintiff at the Adams County Detention Facility. However, Plaintiff is not at the jail in Brighton, but is currently at the Adams Community Corrections Program - Phoenix Center, 8031 Highway I-76, Henderson, CO 80640. Accordingly, the clerk of the court shall resend a copy of the March 27 minute order to Plaintiff at the Henderson, Colorado, address along with a copy of this minute order. Plaintiff shall file an amended Prisoner Complaint, on the court-approved Prisoner Complaint form, in compliance with the March 18 Order, within 30 days from the date of this minute order. Plaintiff need not submit any exhibits to the Court at this time. In the amended Prisoner Complaint, Plaintiff may not incorporate by reference exhibits previously submitted. The necessary supporting factual allegations must be alleged in the body of the amended Prisoner Complaint. March 18, 2024 Opinion or Order Filing 5 ORDER DIRECTING PLAINTIFF TO FILE AMENDED PRISONER COMPLAINT For the reasons discussed herein, it is ORDERED that Plaintiff file within thirty (30) days from the date of this order, an amended Prisoner Complaint, on the court-approved Prisoner Complaint form, that complies with the directives in this order. Plaintiff shall obtain a copy of the current Prisoner Complaint form, along with the applicable instructions, with the assistance of his case manager or the facility's legal assistant, at http://www.cod.uscourts.gov/CourtOperations/RulesProcedures/Forms.aspx. March 11, 2024 Opinion or Order Filing 4 ORDER GRANTING LEAVE TO PROCEED PURSUANT TO 28 U.S.C. 1915 The Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 (ECF No. #3 ) is GRANTED. Within thirty days of the date of this Order Plaintiff's custodian shall disburse from Plaintiffs prison account an initial partial filing fee of $15.00 to the Clerk of the United States District Court for the District of Colorado, which represents 20 percent of the greater of the (1) average monthly deposits, or (2) average monthly balance in Plaintiff's prison account for the six-month period immediately preceding the filing of the complaint. See 28 U.S.C. 1915(b). After payment of the initial partial filing fee Plaintiffs custodian shall disburse from Plaintiffs prison account monthly payments of 20 percent of the preceding months income credited to his prison account until Plaintiff has paid the total filing fee of $350.00. See 28 U.S.C. 1915(b)(2). Interference by Plaintiff in the submission of these funds will result in the dismissal of this action. Plaintiffs custodian shall continue to disburse monthly payments from Plaintiffs prison account until full payment of the filing fee has been paid to the Court, even after disposition of the case and regardless of whether relief is granted or denied. The United States Marshals Service shall serve process on any remaining Defendants for whom personal service is required if the case is later drawn to a district judge and/or a magistrate judge under D.C.COLO.LCivR 8.1(c).
