May 21, 2024 Opinion or Order Filing 5 ORDER TO SHOW CAUSE: returnable by Plaintiff. The factual underpinnings of this case are the same as all other of Plaintiff's cases; that is, the investigation by Colorado regulators into Plaintiff's business activities and the eventual revocation of his professional license. Here, Plaintiff asserts a single claim for the violation of the Eighth Amendment prohibition of cruel and unusual punishment. But the Eighth Amendment's proscription against "cruel and unusual punishment" applies only to convicted inmates. Perkins v. Kan. Dep't of Corr., 165 F.3d 803, 809 (10th Cir. 1999) ("The Eighth Amendment, which applies to the States through the Due Process Clause of the Fourteenth Amendment, prohibits the infliction of cruel and unusual punishments on those convicted of crimes."). As far as this Court understands--based on Plaintiff's many allegations across his myriad cases, Plaintiff has neither been charged nor convicted of any crime related to the revocation of his license. Consequently, IT IS ORDERED on or before the close of business on May 31, 2024, Plaintiff shall SHOW CAUSE in writing why this case should not be dismissed for being frivolous on its face.
