ORDER DIRECTING PLAINTIFF TO CURE DEFICIENCIES. By Magistrate Judge Richard Thomas Gurley on 07/22/2024. It is ORDERED that Plaintiff cure the deficiencies designated above within thirty days from the date of this order if he wishes to pursue claims in this action. Any papers that Plaintiff files in response to this order must include the civil action number on this order. It is FURTHER ORDERED that Plaintiff must obtain and utilize the current court-approved Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 form, which can be obtained (with the assistance of Plaintiff's case manager or the facility's legal assistant), along with the applicable instructions, at www.cod.uscourts.gov. It is FURTHER ORDERED that if Plaintiff fails to cure the designated deficiencies within thirty days from the date of this order, the action may be dismissed without further notice. It is FURTHER ORDERED that: (1) the Motion for Appointment of Counsel (ECF No. 3); (2) Motion to Produce Records (ECF No. 4); and (3) Motion Pursuant to Fed. R. Civ. P. 38 (ECF No. 5) are denied without prejudice as premature because Plaintiff has not yet properly commenced an action by filing a pleading on the court-approved form and addressing the applicable filing fee.(jrobe, )
