Filing 6 ORDER DIRECTING PLAINTIFF TO CURE DEFICIENCY It is ORDERED that Petitioner cure the deficiencies designated above within thirty days from the date of this order. Any papers that Plaintiff files in response to this order must include the civil action number on this order. Petitioner shall obtain the current, court-approved Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 form, and Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action form. If Petitioner fails to cure the designated deficiency within thirty days from the date of this order, the action will be dismissed without further notice. The dismissal shall be without prejudice. Filing 3 MEMORANDUM ORDER (Transferring Action)- Petitioner has submitted a 28 U.S.C. 2241 petition, which challenges the execution of his sentence. Specifically, Petitioner challenges how the Bureau of Prisons is calculating his sentence. "Whenever a 2241 habeas petitioner seeks to challenge his present physical custody within the United States, he should name his warden as respondent and file the petition in the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 428 (2004) (emphasis added). Petitioner is currently detained in Florence USP-High, in Colorado.
