Filing 14 MINUTE ORDER: This matter is before the Court on the Parties' "Joint Motion for Extension of Time" filed at ECF #11 and "Joint Motion for Extension of Time" filed at ECF #12 . To begin, the Motions are identical except that the earlier-filed Motion., ECF #11 , is missing Plaintiff's counsel's signature. Compare ECF #11 with ECF #12 . Accordingly, the earlier-filed Motion [ECF #11 ] is denied as moot in light of the later-filed Motion seeking identical relief. The Parties' Motion [ECF 12] is granted as follows. The Court ORDERS (1) Within thirty (30) days after the Court appoints a lead plaintiff, the lead plaintiff shall either file an amended complaint, or designate the current Complaint, ECF #1 , as the operative pleading in this case; (2) Defendants' deadline to answer or otherwise respond to the complaint is reset to thirty (30) days after the lead plaintiff (a) files an amended complaint or (b) designates the current Complaint, ECF #1 , as the operative pleading; (3) The Scheduling Conference currently set for December 18, 2024 is vacated. The Court shall reset the Scheduling Conference, if necessary, after the Court rules on any forthcoming motion to dismiss; (4) Should Defendants file an answer in lieu of a motion to dismiss, the Parties shall promptly contact the Magistrate Judge's Chambers by joint email requesting dates to reset the Scheduling Conference; and (5) The Parties shall file a Joint Status Report every ninety (90) days, beginning March 6, 2025, alerting the Court of the status of this case and whether the Scheduling Conference should be reset.
