ORDER by Magistrate Judge Susan Prose on February 13, 2025. Plaintiff filed suit on December 30, 2024. As of this Order, returns or waivers of service for Defendant Conoco, Inc. has not been filed. Federal Rule of Civil Procedure 4(m) provides that "[i]f a defendant is not served within 90 days after the complaint is filed, the court, on motion or on its own after notice to the plaintiff, must dismiss the action without prejudice against that defendant or order that service be made within a specified time." Accordingly, if Plaintiff has not filed returns or waivers of service (or sought an extension to do so) for Defendant by March 30, 2024, this court may recommend dismissal without prejudice without further notice to Plaintiff.
