ORDER. This matter is before the Court on Wellpath Holdings, Inc.'s ("Wellpath") Notice of Filing of Chapter 11 Bankruptcy Case by Named Defendant and Automatic Stay of Proceedings (ECF No. 13). On November 11, 2024, Wellpath filed for Chapter 11 bankruptcy in the United States Bankruptcy Court for the Southern District of Texas. On November 12, 2024, the Bankruptcy Court for the Southern District of Texas issued an Amended Interim Order Enforcing the Automatic Stay, extending the automatic litigation stay pursuant 11 U.S.C. 362 against Wellpath as the debtor to non-debtor co-defendants. See Bankruptcy Court Case No. 24-90533, Dkt. 69. On January 15, 2025, the Bankruptcy Court for the Southern District of Texas issued an Amended Order (I) Enforcing the Automatic Stay on a Final Basis with Respect to Certain Actions (II) Enforcing the Automatic Stay on an Interim Basis with Respect to Certain Actions, (III) Extending the Automatic Stay on an Interim Basis to Certain Actions against Non-Debtors, (IV) Setting a Final Hearing for the Interim Relief Granted Herein, and (V) Granting Related Relief. The automatic stay is applicable in this case. It is hereby ORDERED that this case is hereby STAYED, and no action shall be taken until further order of the Court. It is further ORDERED that all pending motions will be DENIED WITHOUT PREJUDICE, with leave to refile after the stay has been lifted or the parties are granted relief from the stay from the Bankruptcy Court. The Clerk of Court is ORDERED to ADMINISTRATIVELY CLOSE this case subject to any party moving to reopen it for good cause, including if the stay is lifted or relief from the stay is granted.
