ORDER This matter is before the Court on Plaintiffs #33 Motion. The Court DENIES the Motion for the following reasons: First, pursuant to Fed. R. Civ. P. 5(a)(1)(B), a party must serve a pleading filed after the original complaint on every other party, including pro se litigants. Plaintiff does not allege Defendants failed to serve him with their filings, but rather objects to the timing of that service. However, Plaintiff cites no authority to support his request that the Court require Defendants to send filings more quickly. See D.C.COLO.LCivR 7.1(d) ([A] motion involving a contested issue of law shall state under which rule or statute it is filed and be supported by a recitation of legal authority in the motion."). To the extent Plaintiff seeks the opportunity to confer on Defendants' motions, the Court clarifies that under D.C.COLO.LCivR 7.1(b)(1), Defendants are not required to confer on a motion filed in a case involving an unrepresented prisoner, as is the case here. Second, to the extent Plaintiff seeks changes to the mailroom operations at Limon Correctional Facility (LCF), this Court lacks the authority to direct or modify internal procedures of a state correctional facility. Finally, the Court clarifies that Defendants' Counsel, Philip Timothy Barrett has entered appearance in this case by signing and filing a pleading in accordance with D.C.COLO.LAttyR 5(a)(1). ORDER REFERRING CASE to Chief Magistrate Judge Scott T. Varholak. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of Local Civ. R. 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, (3) hear and determine pretrial matters, including discovery and other non-dispositive motions, (4) conduct hearings, including evidentiary hearings, and submit proposed findings of fact and recommendations for rulings on dispositive motions, and (5) pursuant to Local Civ. R. 16.6 and at the discretion of the Magistrate Judge, convene such early neutral evaluation and/or settlement conferences and direct related procedures as may facilitate resolution of this case without the necessity of a motion or prior authorization of the undersigned. ORDER GRANTING LEAVE TO PROCEED PURSUANT TO 28 U.S.C. 1915 By Magistrate Judge Richard T. Gurley on 04/03/2025. ORDERED that the Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 (ECF No. #2 ) is granted. FURTHER ORDERED that within thirty days of the date of this Order, Plaintiff's custodian shall disburse from Plaintiff's prison account, if funds are available in keeping with 28 U.S.C. 1915(b), an initial partial filing fee of $44.00 to the Clerk of the United States District Court for the District of Colorado, which represents 20 percent of the greater of the (1) average monthly deposits, or (2) average monthly balance in Plaintiff's prison account for the six-month period immediately preceding the filing of the complaint. FURTHER ORDERED that after payment of the initial partial filing fee, Plaintiff's custodian shall disburse from Plaintiff's prison account monthly payments of 20 percent of the preceding months income credited to his prison account until Plaintiff has paid the total filing fee of $350.00. See 28 U.S.C. 1915(b)(2). Interference by Plaintiff in the submission of these funds will result in the dismissal of this action. FURTHER ORDERED that Plaintiff is advised that notwithstanding any filing fee, or any portion thereof, that may have been paid, the Court shall dismiss at any time all or any part of such complaint which (1) is frivolous or malicious; (2) fails to state a claim on which relief can be granted; or (3) seeks monetary relief from a defendant who is immune from such relief. FURTHER ORDERED that Plaintiffs custodian shall continue to disburse monthly payments from Plaintiff's prison account until full payment of the filing fee has been paid to the Court, even after disposition of the case and regardless of whether relief is granted or denied.
