ORDER This matter is before the Court on #14 Motion for Clarification. In cases removed from any state court to any district court of the United States in which the service has not been perfected prior to removal, such process of service may be completed or new process issued in the same manner as in cases originally filed in such district court. See 28 U.S.C. 1448. Thus, in a removed case, the 90-day time for service set by Federal Rule of Civil Procedure 4(m) is measured from the date of removal, not the date of filing of the state law case. See Wallace v. Microsoft Corp., 596 F.3d 703, 706-707 (10th Cir. 2010) (After the removal of an action from state court... the case will proceed as if it originally had been brought in the federal court, finding that 28 U.S.C. 1448 granted a plaintiff an additional period [now 90 days] for service beginning from the date of removal). The Court, therefore, clarifies that the deadline for Plaintiff to serve the remaining Defendant is July 10, 2025. SO ORDERED, by Magistrate Judge Scott T. Varholak on 5/13/2025. Text Only Entry(stvlc6, )
