ORDER re #70 Motion for Extension of Time to Answer or Otherwise Respond by Alio, Inc. The Court has reviewed the Motion and the Response as well as the previous Motion for Extension of Time filed by the remaining Defendants. In doing so, the Court notes a potential conflict in Plaintiffs' position. Although Plaintiffs oppose Alio's request for additional time and ask this Court to maintain the Clerk's entry of Default, the Court also observes Plaintiffs have indicated their intent to file an amended pleading, which would render the Clerk's entry of Default moot. It is the preference of courts in this district to have cases decided on the merits as opposed to technicalities. In light of the foregoing, and because Alio has now entered an appearance and is prepared to defend this action, the Court finds good cause to sua sponte SET ASIDE the entry of Default. See Miller v. Madison, No. 1:12CV0874 (LEK/CFH), 2013 WL 2181240, at *2 (N.D.N.Y. May 20, 2013) ("Because Rule 55(c) does not refer to a motion requirement, a court may set aside an entry of default sua sponte."). Alio will be given the same amount of time to answer or otherwise respond to the forthcoming amended complaint as the other Defendants. Finally, with respect to the parties' conferral on this matter, the Court will on this one occasion give Alio the benefit of the doubt that it did not intentionally misrepresent Plaintiffs' position on this motion. Should similar conflicts arise in the future, it will be less willing to do so. IT IS ORDERED the Clerk of Court shall set aside the entry of Default as against Alio. SO ORDERED by Judge S.
