Minute Order: For good cause shown, and after consideration of the factors enunciated in String Cheese Incident, LLC v. Stylus Shows, Inc., No. 02-cv-01934-LTB-PA, 2006 WL 894955, at *2 (D. Colo. Mar. 30, 2006), the parties' Joint Motion To Stay of Scheduling Conference, ECF No. #78 , is GRANTED. A stay will not prejudice the plaintiff, who does not oppose the motion, ECF No. #78 , will avoid burdening the parties with the costs of litigating pending a decision on the Motion to Dismiss, promotes judicial economy and efficiency, has no impact on nonparties, and is in the public interest. Accordingly, it is further ORDERED that this case is STAYED until otherwise ordered by the Court. The Scheduling Conference set for December 3, 2025 is VACATED. It is further ORDERED that, within seven days of the District Judge's ruling on this Court's recommendation regarding the Motion to Dismiss, ECF No. #69 , if any of the plaintiffs claims remain, the parties shall jointly contact chambers at [email protected] to set either a Scheduling Conference or a Status Conference. Before the Court is the defendant's Partially Unopposed Motion by Defendant For (1) Extension of the Page Limit for Defendant's Motion to Dismiss Plaintiff's Amended Complaint; and (2) Extension of Time for Defendant to File its Motion to Dismiss Plaintiff's Amended Complaint (the "Motion"). ECF No. #59 . In response, the plaintiff asserts that the defendant's request for an extension of time should be denied because "[t]ime is the 'whole ench[i]lada.'" ECF No. #61 . Although the plaintiff correctly points out that this is not the first time the defendant requests an extension of time, the other extensions generally unopposed mainly related to awaiting the Court's decision on the motion for preliminary injunction, and this is the first time the defendant has requested an extension of time to file a responsive pleading to the amended complaint. As such, for good cause shown, and without awaiting a reply from the defendant, see D.C.COLO.LCivR 7.1(d), the Motion, ECF No. #59 , is GRANTED. Civ. P. 41(a)(1)(A)(i), under which a plaintiff may dismiss a civil action without a court order. But the plaintiff seeks to dismiss only a subset of his claims in the action, and the "rule speaks to dismissal of an action, not just a claim within an action." Gobbo Farms & Orchards v. Poole Chem. Co., 81 F.3d 122, 123 (10th Cir. 1996). Accordingly, the Notice is ineffective on its own to dismiss the claims it references.
