MINUTE ORDER: This matter is before the Court on the #33 Stipulation for Dismissal Without Prejudice of Defendants Community Education Centers, Inc. ("CEC") and Arapahoe County Residential Center ("ACRC"). Rule 41 of the Federal Rules of Civil Procedure states that a case may be dismissed without a court order by filing "a stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ. P. 41(a)(1)(A)(ii). Here, the #33 Stipulation is expressly between Plaintiffs and Defendant GEO Group, Inc. and is not signed by Defendants CEC and ACRC. Accordingly, the Court CONSTRUES the filing as a Motion to Voluntarily Dismiss Defendants CEC and ACRC under Rule 41(a)(2). The Motion is GRANTED, Plaintiffs' claims against Defendants CEC and ACRC are DISMISSED without prejudice, and the Clerk of Court is DIRECTED to terminate CEC and ACRC as Defendants in this action. ORDER REFERRING CASE: This case is referred to Magistrate Judge Kathryn A. Starnella for non-dispositive matters. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ.
