Plaintiffs direct the Court to caselaw supporting that "the 21-day period embodied in Rule 15 for amendments 'as of right' should be applied to each defendant separately." Bank of Am., N.A. v. TemPay LLC, 2020 WL 1933605, at *3 (W.D.N.Y. Apr. 21, 2020). But the authority is not as one-sided as Plaintiffs purport it to be. Rather, "[w]here multiple defendants are named in the complaint, courts are split regarding whether the 21-day period begins on the date the earliest defense action is filed or whether each defendant is treated separately for purposes of calculating the plaintiff's window to amend once as a matter of course under Rule 15(a)." Gordy v. Cnty. of Los Angeles, 2022 WL 2189621, at *1 (C.D. Cal. May 4, 2022); see also Allen v. Vintage Pharm. LLC, 2019 WL 542981, at *3 (M.D. Ga. ORDER. This matter is before the Court on Plaintiffs' Response to Order to Show Cause #105 . Plaintiffs direct the Court to caselaw supporting that "the 21-day period embodied in Rule 15 for amendments 'as of right' should be applied to each defendant separately." Bank of Am., N.A. v. TemPay LLC, 2020 WL 1933605, at *3 (W.D.N.Y. Apr. 21, 2020). But the authority is not as one-sided as Plaintiffs purport it to be. Rather, "[w]here multiple defendants are named in the complaint, courts are split regarding whether the 21-day period begins on the date the earliest defense action is filed or whether each defendant is treated separately for purposes of calculating the plaintiff's window to amend once as a matter of course under Rule 15(a)." Gordy v. Cnty. of Los Angeles, 2022 WL 2189621, at *1 (C.D. Cal. May 4, 2022); see also Allen v. Vintage Pharm. LLC, 2019 WL 542981, at *3 (M.D. Ga. Feb. 11, 2019) (describing split). Though the Tenth Circuit has not yet weighed in, it appears that the majority of district courts in this Circuit to consider the issue have taken the view that the 21-day period to amend as a matter of course is measured from the filing of the earliest defense. See Schwab v. Ingels, 2020 WL 2037049, at *4-5 (D. Kan. Apr. 28, 2020); Weathers v. Circle K Stores, Inc., 434 F. Supp. 3d 1195, 1201 n.1 (D.N.M. Jan. 9, 2020); Atkins v. Heavy Petroleum Partners, LLC, 86 F. Supp. 3d 1188, 1197-98 (D. Kan. 2015); Trujillo v. City of Newton, Kan., 2013 WL 535747, at *1 (D. Kan. Feb. 12, 2013); but see Spak v. Riturani, 2022 WL 3715808, at *2 (D.N.M. Aug. 29, 2022); Culver v. Lithia Motors, Inc., 2016 WL 7426587, at *7 (D.N.M. May 12, 2016). This Court adopts the same view.
