Filing 19
This matter is before the Court on Plaintiff's Motion for Recusal and Disqualification [#13] which was referred to the undersigned to the extent it seeks the undersigned's recusal. A United States magistrate judge "shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned." 28 U.S.C. 455(a)(2023). In the Tenth Circuit, disqualification should occur in cases where "a reasonable person, knowing all the relevant facts, would harbor doubts about the judge's impartiality." United States v. Cooley, 1 F.3d 985, 993 (10th Cir. 1993) (quotation omitted). This is an objective standard. Id.; see also In re McCarthey, 368 F.3d 1266, 1269 (10th Cir. 2004). The relevant inquiry is whether, based on the judge's "outward manifestations and reasonable inferences drawn therefrom," a sufficient factual basis exists to reasonably question the judge's impartiality. Cooley, 1 F.3d at 993. Here, it appears Plaintiff argues for my recusal based on previous adverse rulings, as well as complaints Plaintiff has made to others about those rulings, but adverse rulings against a litigant do not provide a sufficient basis for recusal. Cooley, 1 F.3d at 994 (affirming that motions to recuse will be denied if based on "prior rulings in the proceeding...solely because they were adverse"); Glass v. Pfeffer, 849 F.2d 1261, 1268 (10th Cir. 1988) (affirming "adverse rulings are not in themselves grounds for recusal"); see also Green v. Dorrell, 969 F.2d 915, 919 (10th Cir. 1992) (denying motion to recuse because it alleged no factual basis to warrant recusal but only restated the party's beliefs, and because substance of the motion was "based on adverse rulings," which "cannot in themselves form the appropriate grounds for disqualification"). Accordingly, I do not believe Plaintiff's motion provides a reasonable basis to move for my recusal nor to question my impartiality in this case. The Motion is therefore DENIED to the extent it seeks my recusal from this case. SO ORDERED, by Magistrate Judge Scott T. Varholak on 7/21/2025. Text Only Entry (stv, )

ORDER by Chief Judge Philip A. Brimmer on 7/21/2025. This matter comes before the Court on Motion to Transfer Venue Pursuant to 28 U.S.C. 1404(a) Due to Appearance of Impropriety, Judicial Bias, and Systematic Denial of Redress [Docket No. #14 ]. It is ORDERED that plaintiff's Motion to Transfer Venue Pursuant to 28 U.S.C. 1404(a) Due to Appearance of Impropriety, Judicial Bias, and Systematic Denial of Redress [Docket No. #14 ] is DENIED. (tlove, )

Filing 17
MINUTE ORDER by Chief Judge Philip A. Brimmer on 7/21/2025. This matter is before the Court on plaintiff's Motion to Compel Forthwith Ruling on Emergency Temporary Restraining Order [Docket No. #15 ], wherein plaintiff "moves this Court for immediate ruling on his Request for Emergency Temporary Restraining Order." Docket No. #15 at 1. Plaintiff has not moved for a temporary restraining order. A request for a temporary restraining order in his complaint, see Docket No. #1 at 60, does not constitute a motion for a temporary restraining order. See D.C.COLO.LCivR 7.1(d) ("A motion shall be filed as a separate document."). Therefore, it is ORDERED that plaintiff's Motion to Compel Forthwith Ruling on Emergency Temporary Restraining Order [Docket No. #15 ] is DENIED. (tlove, ) .
