September 5, 2025 Opinion or Order Filing 43 MINUTE ORDER The Court amends its September 3, 2025, 41 Minute Order as follows: The United States Marshall Service (USMS) is directed to attempt service on Defendant McLallen at the address provided by Plaintiff in the Second Amended Complaint. If appropriate, the Marshal shall first attempt to obtain a waiver of service of these documents pursuant to Fed. R. Civ. P. 4(d). All costs of service shall be advanced by the United States. The USMS shall not attempt service for the Defendants already served with the original complaint. (See ECF #15 - #19 , #22 - #29 , #36 ; see also ECF #31 (acknowledging that Defendants City of Pueblo, Medina, Vahlbusch, Masciotra, Ballas, Oliva, Duran, Berumen, Chongway, Proctor, Beauvais, Peil, Chavez, and Pfeifer had been served).)As for Defendant Albaugh, on August 11, 2025, the #14 Summons was returned unexecuted and indicated Mr. Albaugh no longer works for the Pueblo Police Department, and thus cannot be served at 200 S. Main St. Pueblo, CO 81003. Nevertheless, the Second Amended Complaint continues to list Mr. Albaugh's address as 200 S. Main St. (See ECF 42 at 25.) Accordingly, the USMS is directed not to attempt service of Mr. Albaugh at this time. Plaintiff may provide a new address for Mr. Albaugh should he find himself in a position to do so. By Magistrate Judge Maritza Dominguez Braswell on 9/5/2025. For all non-e-filer pro se parties, a copy of this document has been sent via U.S. Mail to the mailing address of record. September 3, 2025 Filing 42 SECOND AMENDED COMPLAINT filed by Harry Cooper.(jrobe, )
September 3, 2025 Opinion or Order Filing 41 MINUTE ORDER: The Court makes the following orders on Plaintiff's pending Motions:First, Plaintiff's #33 Motion to Supplement is granted. The Clerk of Court is directed to docket ECF 33-1 as the Second Amended Complaint. The United States Marshal Service is directed to attempt service for all Defendants at the addresses provided by Plaintiff. If appropriate, the Marshal shall first attempt to obtain a waiver of service of these documents pursuant to Fed. R. Civ. P. 4(d). All costs of service shall be advanced by the United States. Second, in light of the Court's order on the #33 Motion to Supplement, Plaintiff's #30 Motion for Leave to File Second Amended Complaint and #20 Motion to Cure Defective Service are found to be moot. Finally, Plaintiff's #10 Motion for Appointment of Counsel is denied without prejudice. The supply of attorneys willing and able to take civil cases pro bono is extremely limited and the Court must make appointment orders sparingly. This case is still in its earliest stages -- indeed, many Defendants are still unserved -- and the Court finds it premature to order an appointment of counsel. Moreover, the Court notes Plaintiff has proven capable of making filings and advancing his case. Plaintiff may re-file his motion should the case move to a later stage.
