October 15, 2025 Opinion or Order Filing 30 MINUTE ORDER: Plaintiff's #29 Amended Motion to Continue Oral Argument is GRANTED in part and DENIED in part. Plaintiff Matthew Lewis is excused from personally attending oral argument on the Court's October 9, 2025 Order to Show Cause and may appear through counsel. However, oral argument remains set for November 3, 2025 at 01:00 PM in Courtroom A 902, and counsel shall appear in person for oral argument. With respect to Plaintiff's counsel's potential scheduling conflict, the Court has conferred with Judge Varholak's Chambers and confirmed that Plaintiff's counsel will be temporarily excused from her settlement conference before Judge Varholak to attend oral argument in this matter. October 14, 2025 Opinion or Order Filing 28 MINUTE ORDER: Plaintiff's #27 Motion to Continue Oral Argument is STRICKEN for failure to comply with D.C.COLO.LCivR 7.1(a). Local Rule 7.1(a) requires counsel to confer with opposing counsel prior to filing a motion and describe the conferral efforts in the motion or in an attached certificate. Here, Plaintiff's counsel contends that because the Court's October 9, 2025 Order to Show Cause applied only to Plaintiff and his counsel, conferral was not required. But this situation does not present one of the limited exceptions to counsel's duty to confer as enumerated in Local Rule 7.1(b). See D.C.COLO.LCivR 7.1(b). Although the Court did not order Defendant to respond to the Order to Show Cause, the Court did not excuse Defendant from appearing at oral argument either. To the extent Plaintiff's counsel requests an alternative date and time for oral argument, she must fulfill her duty to confer before doing so. By Judge Nina Y. Wang on 10/14/2025. October 9, 2025 Opinion or Order Filing 24 ORDER TO SHOW CAUSE: This matter is before the Court sua sponte. As Plaintiff acknowledges in the Second Motion for Leave to Amend to File Amended Complaint Limited to Correct Citations, [Doc. 19], Plaintiff's operative pleading contains several erroneous citations, see [Doc. 18 at 4-5; Doc. 19 at 2 & n.1]. Plaintiff does not explain how or why these citations came to be in his pleading. Accordingly, no later than October 30, 2025, Plaintiff shall SHOW CAUSE in writing why the Court should not dismiss this action with prejudice and otherwise sanction Plaintiff Matthew Lewis and his counsel for misuse of generative artificial intelligence. See Fed. R. Civ. P. 11(c). Oral argument on this Order is SET for November 3, 2025 at 01:00 PM in Courtroom A 902. By Judge Nina Y. Wang on 10/9/2025. Text Only Entry (nywlc8, )
