For the reasons set forth above, the court respectfully RECOMMENDS that Mr. Jones's motion to remand (Jones ECF No. #16 ) be granted and that the case be returned to the District Court for Broomfield County, Colorado. Relatedly, the court RECOMMENDS deferring any ruling on Mr. Jones's request for costs and fees until Judge Rodriguez ultimately resolves the remand question.
