ORDER DENYING WITHOUT PREJUDICE #20 Motion for Summons be Serve by Publication by Magistrate Judge Susan Prose on 12/26/2025. Plaintiff's #20 Motion for Summons be Serve by Publication is DENIED WITHOUT PREJUDICE.Service by publication is a last-resort method and is permitted under Fed. R. Civ. P. 4(e)(1) only if authorized by state law. Under Colorado law, a motion for service by publication must be verified and supported by an affidavit demonstrating due diligence in attempting personal service. See C.R.C.P. 4(g). Plaintiff's Motion is not verified, is not supported by an affidavit establishing due diligence, and does not otherwise demonstrate that service by publication is authorized. In addition, to the extent Plaintiff seeks to serve a Colorado state agency, Colorado law requires service on the Colorado Attorney General. See C.R.C.P. 4(e)(10)(A)-(B). The Motion does not show that service was attempted on the Attorney General. Plaintiff may file a renewed motion that complies with the applicable rules. Because Plaintiff is proceeding in forma pauperis, the Clerk of the Court is directed to provide Plaintiff with new USM-285 forms. Plaintiff shall complete and return the forms with accurate service instructions, including service on the Colorado Attorney General for the state agency defendant, by January 16, 2026, so that the U.S. Marshals Service may attempt service. Objections to this Order must be filed within fourteen (14) days. Fed. R. Civ. P. 72(a). ORDER REFERRING CASE: This case is referred to Magistrate Judge Susan Prose for all motions. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, (3) hear and determine pretrial matters, including discovery and other non-dispositive motions, and (4) conduct hearings, including evidentiary hearings, and submit proposed findings of fact and recommendations for rulings on dispositive motions. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the request of the Parties by motion, this Court may direct the Parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. Alternatively, the Magistrate Judge, at her discretion, may convene such early neutral evaluation and/or settlement conferences and direct related procedures as may facilitate resolution of this case without the necessity of a motion or prior authorization of the undersigned. Counsel for the Parties and all counsel who may later enter an appearance shall review and familiarize themselves with the undersigned's Practice Standards, as well as the Practice Standards of the assigned Magistrate Judge.
