DaVita, Inc., 1:25-cv-02513-RMR-CYC (D. Colo.) (filed Aug. 12, 2025); Frazier v. DaVita, Inc., 1:25-cv-02540-PAB-TPO (D. Colo.) (filed Aug. 14, 2025); Riden v. DaVita, Inc., 1:25-cv-02622-CYC (D. Colo.) (filed Aug. 20, 2025); Ellman v. DaVita, Inc., 1:25-cv-02629-TPO (D. Colo.) (filed Aug 21, 2025); and Barboza v. DaVita Inc., 1:25-cv-02633-STV (D. Colo.) (filed Aug. 21, 2025). A court may consolidate actions if they involve a common question of law or fact. Fed. R. Civ. P. 42(a); see also Local Civ. R. 42.1. The cases at issue involve common questions of law and fact, as all are putative class actions against Defendant DaVita, Inc. alleging, among other things, the improper disclosure of personally identifiable information and protected heath information resulting from a data breach. All parties, including plaintiffs in the six additional cases, consent to consolidation. Accordingly, the plaintiffs' motion is granted, and this case is hereby CONSOLIDATED with the following cases: Nos. 1:25-cv-02458-STV, 1:25-cv-02513-RMR-CYC, 1:25-cv-02540-PAB-TPO, 1:25-cv-02622-CYC, 1:25-cv-02629-TPO, and 1:25-cv-02633-STV. These cases are deemed to be Related Actions for purposes of this Courts June 16, 2025 Order 21 Granting Motion to Consolidate and Appoint Co-Lead Class Counsel.
