Minute Order by Judge Jinsook Ohta: Plaintiff Robert Clark filed a class action lawsuit against Defendants Instant Checkmate, LLC; Intelius, LLC; and Truthfinder, LLC, alleging that Defendants published his and other Colorado residents' phone numbers on their online personal directories without their consent, violating Colorado's Prevention of Telemarketing Fraud Act, Colo. Rev. Stat. 6-1-304(4)(a)(I). Dkt. 1-2. On June 25, 2025, Defendants filed a motion to transfer venue under 28 U.S.C. 1404(a) to the District of Colorado, or, in the alternative, to transfer or dismiss the case for forum shopping. Dkt. #11 . District courts have broad discretion to transfer cases under 1404(a) to any district where the case could have been brought if transfer would serve the interests of convenience and fairness. 28 U.S.C. 1404(a); Jones v. GNC Franchising, Inc., 211 F.3d 495, 498 (9th Cir. 2000). In the Ninth Circuit, factors courts consider may include: "(1) plaintiff's choice of forum; (2) convenience of the parties; (3) convenience of the witnesses; (4) ease of access to the evidence; (5) familiarity of each forum with an applicable law; (6) feasibility of consolidation with other claims; (7) any local interest in the controversy; and (8) the relative court congestion and time of trial in each forum." Hawkins v. Gerber Prods. Co., 924 F. Supp. 2d 1208, 1213 (S.D. Cal. 2013).Here, the Court finds that venue is proper in the District of Colorado and the convenience and fairness factors favor transfer. The Court gives Plaintiff's choice of a Southern District of California forum little deference because this is a class action, and one comprised of Colorado class members whose privacy was violated under Colorado law. Lou v. Belzberg, 834 F.2d 730, 739 (9th Cir. 1987) ("minimal consideration" given to plaintiff's choice of forum in class action or if "the operative facts have not occurred within the forum and the forum has no interest in the parties or subject matter"). It appears that both parties are forum shopping to some extent: we have a Colorado plaintiff alleging a violation of Colorado law on behalf of a Colorado class seeking a California forum, and a local California defendant seeking a convenience-based transfer to Colorado. Because there is forum shopping on both sides, the Court finds that forum shopping does not weigh on the choice of forum factor. Accord Hawkins, 924 F. Supp. 2d at 1215 (choice of forum should be disregarded if plaintiff is forum shopping). The convenience of parties and witnesses factors are split, because Defendants and their employees are located in the Southern District, whereas Plaintiff and the putative class members are all located in Colorado, and both parties have represented that they will travel to their preferred forum to testify. Ease of access to evidence is a non-factor in this case given that discovery is largely conducted electronically and parties have identified no physical evidence in the Southern District that needs to be examined. Consolidation with other cases is not available in either court, and relative court congestion does not favor either forum. However, the Court finds that the familiarity with applicable law and local interest in controversy factors both strongly favor transfer to the District of Colorado. At core, this is a Colorado controversy involving a Colorado-only class brought under a novel Colorado law. See Rabinowitz v. Samsung Elecs. Am., Inc., No. 14-CV-00801-JCS, 2014 WL 5422576, at *8 (N.D. Cal. Oct. 10, 2014) ("a fundamental principle underpinning the 1404(a) analysis is that litigation should proceed in that place where the case finds its center of gravity") (internal quotations omitted). Accordingly, because Defendants have represented that their witnesses will travel Colorado to testify, Dkt. 24-1 (Hamilton Decl.), and the other 1404(a) factors are all neutral or favor transfer, the Court GRANTS Defendants' motion to transfer [Dkt. #11 ] and transfers this case to the District of Colorado. Because this transfer is contingent upon Defendants' representation to the Court that it will produce its witnesses to testify in Colorado, the Court further ORDERS Defendants to do so.
