MINUTE ORDER: This matter is before the Court on #13 Plaintiffs' Motion to Request Recognition of Effective Service or in the Alternative, Request for Substitute Service. On review of the Motion, supporting materials, and governing law, it appears United Nations Special Rapporteurs are immune from "legal process" for words spoken or written, and acts performed, in their official capacities. See U.N. Convention on the Privileges and Immunities of the United Nations art. V, 18(a). However, the Motion does not address what appear to be critical questions in this context. Thus, the Court directs Plaintiffs to submit supplemental briefing to address the following: 1. Does the phrase "legal process," as used in Article V, 18(a) of the Convention, include service of process, such that Defendant might be immune, even from service of process, so long as the alleged acts were taken in an official capacity?2. What standard governs the immunity inquiry at this stage of the proceedings? Is it sufficient that a pleading plausibly alleges culpable conduct that occurred outside the scope of Defendant's official capacities? If that were the case, it seems any plaintiff could plead around immunity. Does the applicable standard require something more?3. Applying the correct legal standard, what specific conduct was taken outside of Defendant's official capacity? This discussion shall describe the scope and contours of Defendant's mandate, identify the specific conduct at issue (with citations to the #1 Complaint), and provide legal authority to support Plaintiffs' position that the alleged conduct falls outside that mandate.Supplemental briefing is due on or before February 27, 2026, and shall not exceed 15 pages.
