In light of (1) the parties' agreement that this matter "shall be dismissed with prejudice and all claims of Plaintiffs against the Defendant shall be reserved and referred to arbitration," id. 1; and (2) their request that "this action be administratively closed pending arbitration," id. 2, the Court ORDERS that this case be administratively closed. MINUTE ORDER. This matter comes before this Court upon its own review of the case record. In light of the Parties' Amended Stipulation for Arbitration [ECF #19 ], the Scheduling Conference is vacated. The Parties did not file the Consent/Non-Consent to United States Magistrate Judge Jurisdiction form [ECF #7 ] by the January 30, 2026 deadline [ECF #21 ], and thus, the Parties have not expressed consent to magistrate judge jurisdiction. In addition, the Parties through their Amended Stipulation for Arbitration seek dispositive relief that would require dismissal or closure of the case. Therefore, pursuant to D.C.COLO.LCivR 40.1(c)(3), the Court directs the Clerk of the Court to reassign this case under D.C.COLO.LCivR 40.1(a) to a District Judge. This Court may continue on the case to hear matters referred by the district judge under 28 U.S.C. 636(b), Fed. R. Civ. P. 72, and D.C.COLO.LCivR 72.1(c). MINUTE ORDER. This matter comes before this Court upon the Stipulation for Arbitration [ECF #16 ] filed by Plaintiffs and one of the two named Defendants, Uber Technologies, Inc. ("Uber"). Before this Court takes action on their Stipulation, however, this Court requests clarification on two points: First, Plaintiffs and Defendant Uber shall clarify whether this civil action against Defendant Uber should be dismissed or stayed. In practical effect, the Stipulation requests dismissal of Plaintiffs' claims without prejudice to their ability to resolve them in arbitration. However, the Stipulation also makes inconsistent statements about stays. For example, the last sentence of the Stipulation requests that this civil action "be stayed while the Proceeding is pending in binding arbitration." ECF #16 at p. 4. Second, Plaintiffs and Defendant Uber shall clarify whether this civil action should remain open for purposes of the claim against Defendant Isaac Bagin. The Stipulation makes no mention of him, and there is only one statement referencing the "action involving Plaintiff and the remaining parties." ECF #16 6 (emphasis added). If Plaintiffs and Defendant Uber intend for this civil action to remain open for Plaintiffs' claim against Defendant Bagin, then they shall address how this Court has federal subject matter jurisdiction to hear it after the dismissal of Defendant Uber. Plaintiffs and Defendant Uber shall file a Joint Statement answering the above questions by December 12, 2025. Alternatively by the same deadline Plaintiffs and Defendant Uber may file an Amended Stipulation for Arbitration if clarifying its terms would resolve this Court's concerns.
