Nos. #77 , #77 -1 #77 -8, #79 , and #79 -1 #79 -9 Pending Defendant's Motion to Restrict These Filings (Doc. #80 ) filed March 24, 2026, is SUSTAINED IN PART AND OVERRULED IN PART. Defendants seek to place under Level 1 restriction plaintiffs affidavits of bias and attachments thereto. Plaintiffs affidavits (Documents #77 and #79 ) appear to be identical, duplicate "Affidavit[s] of Judicial Bias or Prejudice According to 28 U.S.C. Section 455(B)(1) and Certificate of Counsel; Exhibits 1-9)." Exhibits 1 through 7 to each affidavit are Complaints of Judicial Misconduct or Disability against judges who have recently taken judicial action in this case (Judges Jerome A. Holmes, Kathryn H. Vratil, Gwynne E. Birzer, Harris L. Hartz, Philip A. Brimmer and the Tenth Circuit Judicial Council). Exhibit #77 -8 is a 462-page document which is a compendium of various letters, plaintiff's application to serve on the Colorado Supreme Court (with a letter of recommendation), judicial misconduct complaints by plaintiff, the "workplace culture" report by the Colorado Judicial Branch, newspaper articles, the oral history of District Judge John L. Kane, objections to potential Inn of Court membership applications, etc., etc, etc.) Almost all of the exhibits are immaterial to the recusal question and plaintiff has made no effort to curate his exhibits or explain their relevance. On the other hand, defendants have made no effort to identify specific documents which might actually merit restricted access. Under Article VIII, Section 23 of the Rules for Judicial-Conduct and Judicial-Disability Proceedings for federal judges, information about a complaint must not be publicly disclosed "by any judge or judicial employee, or by any person who records or transcribes testimony except as allowed by these Rules." A complainant is generally free to disclose the existence of the complaint and discuss it publicly. Defendants may be entitled to restrictions on information regarding state judicial disciplinary investigations which plaintiff acquired as an employee of the Colorado Commission on Judicial Discipline. The exhibits to plaintiff's affidavits contain a small and finite segment of information which might fall in that category. Accordingly, the Court grants defendants' motion for a 72-hour period commencing at 5:00 PM COLORADO TIME ON MARCH 24, 2026. The restricted shall automatically be lifted unless defendants file by 5:00 PM COLORADO TIME ON MARCH 27, 2026, a motion to place permanent restrictions on a small subset of pleadings and exhibits which might actually be protected under Colorado law.
