| Filing 33 COURTROOM MINUTES for Scheduling Conference held on 2/17/2026 before Magistrate Judge Susan Prose. For the reasons stated on the record, it is ORDERED: Pursuant to Fed. R. Civ. P. 16(b)(2), this court finds good cause to delay issuing a scheduling order until after Defendant's Renewed Motion to Dismiss (ECF No. 26) is resolved. See Sandoval v. United States, No. 11-cv-01533-REB-KLM, 2011 WL 3682768, at *2 (D. Colo. Aug. 23, 2011) ("Questions of jurisdiction should be resolved at the earliest stages of litigation, so as to conserve the time and resources of the Court and the parties. Thus, a stay of discovery during the pendency of a dispositive motion asserting a jurisdictional challenge may be appropriate and efficient.").Accordingly, discovery in this matter is STAYED pending a ruling on the Motion to Dismiss. Within 30 days following a ruling on th eMotion to Dismiss, the parties shall submit a joint Status Report proposing a date to reset the Scheduling Conference. On or before May 18, 2026, the parties shall file a joint Status Report apprising this court regarding the status of the underlying case pending in Boulder County.FTR: A 502. | Filing 32 Proposed Scheduling Order by Plaintiff New Cingular Wireless PCS, LLC. (Rhoades, Meshach) |
| Filing 31 REPLY to Response to #26 Renewed MOTION to Dismiss filed by Defendant MJF 2801 Jay Rd Development LLC. (Culhane, Daniel) |
Filing 30
ORDER: Plaintiff seeks leave to file "additional pages to its Opposition to Defendants' Renewed Motion to Dismiss." ECF No. #28 at 1. Four additional pages, specifically. Id. Whereas this relief is specified, Plaintiff fails to specify any principled basis for seeking such relief only that additional pages are necessary because Plaintiff must "address challenges brought under both" Rule 12(b)(1) and Rule 12(b)(6) "on three separate claims." Id. While the Court "will entertain motions for extensions of page limit where appropriate and for good cause," CNS Civ. Practice Standard 10.1(c)(5), nothing about describing the basic function of a brief amounts to good cause. Moreover, Plaintiff failed to properly confer before filing its motion, in contravention of the Local Rules. See D.C.COLO.LCivR 7.1(a). These failures to comply with the Court's Practice Standards and Local Rules are emblematic of a bigger problem: How this case has been plagued by the failure of both parties to follow and comply with this Court's Uniform Practice Standards and this Districts Local Rules. See, e.g., ECF Nos. 12 , 19 , 25 . Despite Plaintiff's failures, the Court GRANTS Plaintiff's motion. ECF No. #28 . The Court notes, for the benefit of both parties, that any future filings that fail to comply with these Practice Standards or Local Rules will be summarily stricken. By Judge Charlotte N. Sweeney on 1/26/2026. Text Only Entry(cnsja, )
