January 5, 2026 Opinion or Order Filing 14 Before the Court are two Motions filed by Plaintiff: (1) Emergency Motion for Temporary Restraining Order and Preliminary Injunction #7 and (2) Emergency Motion for Temporary Restraining Order #8 . Plaintiff is currently a debtor in a bankruptcy proceeding in the District of Colorado, In re: Mersad Rahmanovic, Case No. 25-12622-MER. Plaintiff filed an Emergency Motion for Temporary Restraining Order in the bankruptcy proceeding based on the same facts he now presents to this Court. The bankruptcy court denied the Motion. After review of the Motions, this Court agrees with the bankruptcy court's reasoning. Namely, the foreclosure of the property was not wrongful, and Defendants did not willfully violate the automatic stay. Accordingly, Plaintiff is not likely to succeed on the merits of any of his claims and both of his Motions ( #7 , #8 ) are DENIED. Further, Plaintiff's complaint alleges a violation of 11 U.S.C. 362(k) of the bankruptcy code for willful violation of the automatic stay. Pursuant to D.C.COLO.LCivR 84.1, "[a] case or proceeding brought under or related to Title 11, United States Code, shall be referred automatically to the bankruptcy judges of this district under 28 U.S.C. 157." In addition, a claim for damages under 362(k) is a core proceeding over which the bankruptcy court has exclusive jurisdiction. Johnson v. Smith (In re Johnson), 575 F.3d 1079, 1083 (10th Cir. 2009). Lastly, Plaintiff's demand for a jury trial does not affect this Courts decision to refer the bankruptcy claim because 362(k) claims are not entitled to jury trials. See In re Renewable Energy Dev. Corp., 500 B.R. 77, 90 (D. Utah 2013). The Court does not consider whether the Plaintiff's remaining claims should be referred at this time. Accordingly, it is HEREBY ORDERED that Plaintiff's claim pursuant to 11 U.S.C. 362(k) is REFERRED to the Bankruptcy Court for the District of Colorado. The Clerk of Court is ORDERED to notify the bankruptcy court of the referral. The Court retains jurisdiction over the non-bankruptcy claims asserted in this action. The remainder of Plaintiff's case is referred to Magistrate Judge Maritza D. Braswell for all motions. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, and (3) hear and determine pretrial matters, including discovery and other dispositive motions. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the request of the parties by motion, this Court may direct the parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. Alternatively, the Magistrate Judge, at their discretion, may convene such early neutral evaluation and/or settlement conferences and direct related procedures as may facilitate resolution of this case without the necessity of a motion or prior authorization of the undersigned. Counsel for the Parties and all counsel who may later enter an appearance shall review and familiarize themselves with the undersigned's Standing Order and Practice Standards, as well as the Practice Standards of the assigned Magistrate Judge.It is FURTHER ORDERED that Plaintiff serve Defendants by February 5, 2026.
